PROCEDURE FOR EXECUTING THE ARCO RIGHTS
Fortacero, S.A. de C.V., and Fortacero SONORA, S.A.P.I. de C.V., here in after “Fortacero” procedure in its nature as the Responsible to attend applications concerning the executionof ARCO Rights:
ARCO RIGHTS:
“Fortacero” in compliance with the Federal Law on Protection of Personal Data Held by Individuals and aware of the importance of your privacy, offers you this procedure to request any information related to the processing of your personal data or exercise any of the rights recognized by the aforementioned ARCO Act, without limitation to do so physically in our offices.
The rights that every individual may exercise, regarding the processing of personal data is shown below:
a) Exercise the right of Access: For us to communicate the data we have about you, arising from the contractual relationship, the formats and/or communications established between both parties.
b) Exercise the Right of Rectification: For you tocommunicate and inform to “Fortacero”, in a reliable way, any data that do not correspond with your business and/or person for us to modify accurately.
c) Exercise the right of Cancellation: In case you want to cancel any data we have about you, arising from the contractual relationship, the formats and/or any communications established between both parties.
d) Exercise the Right Opposition: To define the limitations within the treatment and/or use of personal data, for which you gave us consent in handling.
1. The holder of personal data or his legal representative shall be the only ones authorized to request the exercise of ARCO rights.
2. Application to request the exercise of the ARCO rights may be through:
a) E-mail addressed to: privacidad@fortacero.com
b) Courier service addressed to the Department of Personal Data Management located on Blvd. Carlos Salinas de Gortari Km. 8.8 in Apodaca, NL, C.P. 66600 México.
3. Such application shall be addressed and channeled thru those responsible for the Protection of Personal Data, who will verify that it contains the following:
a) The name of the holder of the data, telephone and complete address, email and/or other means of communication to answer your request.
b) Official ID document certifying the identity of the data holder.
c) A clear and precise description of the personal data and / or the reasons for which it seeks to exercise any of the ARCO rights.
d) Any other item or document that facilitates the location of personal data.
e) In the event of a request for Rectification of personal data, the holder shall also indicate the modifications to be made and provide documentation supporting your request.
4. If the application does not meet any of these requirements, your application will be rejected and the applicant will be informed.
5. If the application meets all the formal requirements, the process will move forward according to the following procedure:
5.1. Those responsible for the Personal Data Protection will notify the Holder and/or his legal representative, within a period of twenty (20) working days from the date on which the request for access, rectification, cancellation or opposition was received; informing the determination taken by the means indicated by the holder’s the application.
5.2. Should the request to access, rectify, cancel or oppose complies and moves forward, it will take effect within fifteen (15) working days from the date on which the response was given.
5.3. In the event a requests for Access to personal data, it shall take effect with a certified proof of identity of the applicant or legal representative, in person.
5.3.1. The right of Access to information will be met when these are made available to the Holder of the personal data; or through the issuance of simple copies, electronic documents or any other means.
6. Those responsible for the Protection of Personal Data, shall assist the areas and staff in the name and on behalf of “Fortacero” to process personal data of the holder and jointly implement the necessary measures to comply with the holder’s request.
7. “Fortacero” reserves the right to deny access to the holder’s personal data, or to perform and implementthe rectification, cancellation or opposition of the data processing grant thereof, in the following cases:
a) When the applicant is not the owner of the personal data, or the legal representative is not duly authorized to do so;
b) Where no personal data of the applicant appears in the database;
c) Where there is a legal impediment or resolution of a competent authority which restricts access to personal data, or not allowing rectification, cancellation or opposition thereof, when the rectification, cancellation and/or opposition had previously been performed.
7.1. Those responsible for the protection of personal data must inform the reason for its resolution and communicate it to the Holder, or if applicable, to the legal representative, within the deadlines established for that purpose, by the same means provided in the application, attaching in the case, pertinent proofs where appropriate.
